筆者はイギリス、ロンドン在住14年で、不動産業界に計12年働いている現役のプロの不動産業界人です。

不動産屋の休憩所にもありましたし、商社や、旅行会社で働いていた時にもイギリスの休憩室には必ずこのポスターがありました。

イギリスの不動産屋賃貸の資格試験の最初の課題がこのHeath and Safety Lawについて理解しているかとあります。

今回はこのポスターをちゃんと精読して、雇用者、雇用主の権利と義務を理解できればと思います。

これからイギリスで長期で駐在される方、学生さんのバイトの方、派遣社員で新しい職場で働かれる方のお役に立てば幸いです。

Health and Safety Law —What you need to know

安全衛生法 —知っておきたいこと

All workers have a right to work in places where risks to their health and safety are properly controlled. Health and safety is about stopping you getting hurt at work or ill through work. Your employer is responsible for health and safety, but you must help.

すべての労働者は、健康と安全に対するリスクが適切に管理されている場所で働く権利があります。健康と安全とは、あなたが仕事中に怪我をしたり、仕事を通じて病気になったりするのを防ぐことです。雇用主は安全衛生に責任を負いますが、あなたも協力しなければなりません。

What employers must do for you  雇用主があなたにしなければならないこと

1 Decide what could harm you in your job and the precautions to stop it. This is part of risk assessment.

仕事上で自分に害を及ぼす可能性のあるものと、それを阻止するための注意事項を決めておく。これはリスクアセスメントの一部である。

2. In a way you can understand, explain how risks will be controlled and tell you who is responsible for this.

あなたが理解できる方法で、リスクがどのようにコントロールされるかを説明し、誰がこれに責任を持つかを教えてください。

3. Consult and work with you and your health and safety representatives in protecting everyone from harm in the workplace.

職場における危害からすべての人を守るために、あなたやあなたの安全衛生担当者と相談し、協力すること。

4. Free of charge, give you the health and safety training you need to do your job.

業務に必要な安全衛生教育を無償で実施する。

5. Free of charge, provide you with any equipment and protective clothing you need and ensure it is properly looked after.

必要な機器や保護服を無償で提供し、適切な手入れをする。

6. Provide toilets, washing facilities and drinking water.

トイレ、洗面所、飲料水を提供する。

7. Provide adequate first-aid facilities.

適切な応急処置施設を提供する。

8. Report major injuries and fatalities at work to our Incident Contact Centre on 0345 300 9923. Report other injuries, diseases and dangerous incidents online at http://www.hse.gov.uk.

職場の重大な負傷や死亡事故は、インシデント・コンタクト・センター（0345 300 9923）に報告してください。その他の傷害、疾病、危険な事故は、www.hse.gov.uk でオンライン報告してください。

9. Have insurance that covers you in case you get hurt at work or ill through work. Display a hard copy or electronic copy of the current insurance certificate where you can easily read it.

仕事中の怪我や仕事を通じて病気になった場合に備えて、保険に加入しておくこと。現在の保険証書のハードコピーまたは電子コピーを見やすい場所に掲示する。

10. Work with any other employers or contractors sharing the workplace or providing employees (such as agency workers), so that everyone’s health and safety is protected.

10職場を共有する、または従業員を提供する他の雇用主や請負業者（派遣社員など）と協力し、全員の健康と安全が守られるようにする。

What you must do　雇用者のあなたがやるべきこと

1. Follow the training you have received when using any work items your employer has given you.

雇用主から与えられた作業道具を使用するときは、受けたトレーニングに従ってください。

2. Take reasonable care of your own and other people’s health and safety.

自分自身や他人の健康や安全に合理的な配慮をすること。

3. Co-operate with your employer on health and safety.

安全衛生について、雇用主と協力する。

4. Tell someone(employer, supervisor, or health and safety representative) if you think the work or inadequate precautions are putting anyone’s health and safety at serious risk.

作業や不十分な予防措置により、誰かの健康や安全が深刻な危険にさらされていると思われる場合は、誰か（雇用主、監督者、安全衛生担当者）に伝えてください。

If there’s a problem 問題がある場合

1. If you are worried about health and safety in your workplace, talk to your employer, supervisor, or health and safety representative.

職場の安全衛生について心配な場合は、雇用主、監督者、安全衛生担当者に相談してください。

3. If after talking with your employer, you are still worried, you can find the address of your local enforcing authority for health and safety and the Employment Medical Advisory Service via HSE’s website* http://www.hse.gov.uk.

雇用主と話をしてもまだ心配な場合は、HSEのウェブ http://www.hse.gov.uk から、安全衛生の地方施行当局と雇用医療相談サービスの住所を確認することができます。
